These terms set out the rules for using the Filmdist website and application, owned by Impulse.pl sp. z o.o. with its registered office in Lębork (“Impulse”), ul. Bolesława Krzywoustego 15A, 84-300 Lębork, Poland, entered in the register of entrepreneurs kept by the District Court Gdańsk-Północ in Gdańsk, 8th Commercial Division of the National Court Register, under no. 0000324829, NIP 6342710713, REGON 241143684, with share capital of PLN 50,000 (fully paid up).

1.General provisions

  1. 1.1

    This website and application (the “Service” or “System”) are used to provide the digital services offered by Impulse, including in particular the Filmdist system, which makes it possible to manage film distribution processes.

  2. 1.2

    All information made available in the Service is published in good faith, in order to provide access to the services and information about them. Impulse is not liable for any damage resulting from actions taken on the basis of materials made available in the Service, unless applicable law or a contract provides otherwise.

  3. 1.3

    Using the Filmdist services requires concluding a contract with Impulse and creating a user account (the “Account”).

2.User account

  1. 2.1

    By registering an Account, the user confirms that the data provided is true and up to date and that they are authorised to provide it.

  2. 2.2

    Impulse is not liable for damage resulting from incorrect data entered by the user or from unauthorised use of the Account.

  3. 2.3

    All data provided during registration is protected in accordance with the Impulse Privacy Policy, available in the Service.

  4. 2.4

    Impulse may temporarily limit or block access to the Account in the event of a breach of the terms of this document or of the provisions of the contract with the user.

3.Requirements and rules of use

  1. 3.1

    By using the Service, the user declares that they are at least 18 years old and have full legal capacity.

  2. 3.2

    The user undertakes to use the Service in accordance with applicable law, the principles of social conduct and these terms.

  3. 3.3

    It is prohibited to use the Service in a way that could:

    • disrupt its operation,
    • lead to unauthorised access to data,
    • threaten the security of the IT system or of other users’ data,
    • infringe the intellectual property rights of Impulse or of third parties.

4.Intellectual property

  1. 4.1

    All materials available in the Service, including content, texts, graphics, software, videos, logotypes and the layout and appearance of the site, are the property of Impulse or of cooperating entities and are protected by copyright and industrial property rights.

  2. 4.2

    The user does not acquire any rights to these materials beyond the right to use them under the contract or these terms.

  3. 4.3

    The following are prohibited in particular:

    • copying, modifying, publishing, distributing or reselling materials without the written consent of Impulse,
    • using data mining, scraping, screen scraping or other automated content retrieval techniques,
    • using framing techniques, meta tags or “hidden text” that make use of the name, trade marks or other designations of Impulse.
  4. 4.4

    An infringement of intellectual property rights results in the immediate withdrawal of all licences or permissions granted and may give rise to claims for damages.

5.Trade marks

  1. 5.1

    The Impulse and Filmdist logos and other trade marks or elements of visual identity placed in the Service are protected by law and may not be used without the written consent of Impulse in any way that could be misleading or harm the reputation of the Company.

6.Final provisions

  1. 6.1

    Impulse reserves the right to make changes to these Terms. The current version is always available in the Service.

  2. 6.2

    Continued use of the Service after changes have been made constitutes acceptance of the new terms.

  3. 6.3

    Matters not regulated by this document are governed by Polish law.

  4. 6.4

    Any disputes arising from the use of the Service or of the services provided by Impulse will be settled by the court having jurisdiction over the registered office of Impulse, unless mandatory provisions of law provide otherwise.
